Criminal Attempt

A Criminal Attempt is a voluntary act that, although done with the specific intent to commit the target offense, falls short of completing the crime. The act in question must be a substantial step in furtherance of that intent. If the target offense is achieved, then the Criminal Attempt would merge into the completed offense. Otherwise, it would be punished as a separate and distinct offense.

Criminal Solicitation occurs whenever an individual incites, counsels, induces, advises, urges, or commands another to commit a crime with the specific intent that the person solicited will commit the underlying target offense.

A Criminal Conspiracy is an agreement between two or more guilty minds to accomplish, attempt or solicit some criminal or unlawful purpose. Furthermore, the Commonwealth must prove some overt act conducted in furtherance of the conspiracy.

If involved in a Criminal Conspiracy, a conspirator may, by virtue of his involvement and participation in the scheme, be held accountable for the foreseeable crimes of other conspirators that were committed in furtherance of the objectives of the original conspiracy.

When charged with any of the above-referenced inchoate crimes, even if the underlying target offense is unsuccessful or not attempted, the accused may still be convicted and punished for the attempt, solicitation and/or conspiracy.
