Inchoate Offenses

The inchoate offenses are Criminal Attempt, Criminal Solicitation and Criminal Conspiracy. These offenses are committed prior to and in preparation of the underlying substantive offense. The inchoate offenses are separate and distinct offenses, even though the underlying offense may not have been completed. As a general rule, the inchoate offense is graded the same as the underlying substantive offense and may or may not merge for the purposes of sentencing.
